BISYS® is the sole copyright owner of the Individual(k) (the "Software"), including the accompanying materials and all documents generated by the Software. Reproduction or duplication by any means of the Software or any accompanying materials or the documents, without the written permission of BISYS®, is strictly prohibited and in violation of federal copyright laws.

Although all reasonable efforts have been taken to ensure that the calculations produced by the Software are consistent with applicable federal law and regulations in effect as of the date of creation, BISYS® cannot guarantee the complete accuracy of the calculations produced by the Software.

The Software provides calculations based on both information selected and entered by the financial organization or client, and on assumptions contained in the Software. It is the responsibility of the financial organization to familiarize itself with the assumptions set forth in the Software, to notify its end users of the existence of such assumptions, and to monitor and educate its employees and agents concerning law changes and the impact such changes may have upon assumptions and projections contained in the Software.

The Software is designed only to assist the financial organization in providing comparison calculations and is not a replacement for competent legal and tax advice. All output must be reviewed to ensure accuracy.

THE SOFTWARE IS BEING PROVIDED TO YOU FOR EVALUATION PURPOSES "AS IS" WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES, CONDITIONS OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. BISYS® SHALL HAVE NO LIABILITY WITH RESPECT TO ANY LIABILITY, LOSS OR DAMAGE CAUSED OR ALLEGED TO BE CAUSED, DIRECTLY OR INDIRECTLY, BY THE SOFTWARE. IN NO EVENT WILL BISYS® BE LIABLE FOR SPECIAL, INDIRECT, CONSEQUENTIAL OR INCIDENTIAL DAMAGES RESULTING FROM THE USE, LOSS OF USE, DATA OR PROFITS, WHETHER BASED ON BREACH OF CONTRACT, NEGLIGENCE OR ANY OTHER ACTION IN LAW OR EQUITY, ARISING OUT OF THE USE OR PERFORMANCE OF THE SOFTWARE.
